## 1. Acceptance of Terms
Welcome to Remotica! By using our platform (website, mobile app, services), you fully accept these Terms and Conditions of Use ("T&C").
**If you do not accept these terms, DO NOT use the Remotica platform.**
### 1.1 Definitions
- **"Remotica"** or **"We"**: The platform operated by [Legal Entity Name], VAT [To be completed]
- **"User"** or **"You"**: The individual who registers and uses Remotica to book workspaces
- **"Partner"**: The venues (cafés, bars, coworking spaces) offering workspaces through Remotica
- **"Workspace"**: Work space (table, desk) offered by a Partner
- **"Booking"**: Confirmed reservation of a workspace for specific date/time
- **"Platform"**: Website remotica.app, mobile app, API and all related services
### 1.2 Minimum Age
You must be **at least 18 years old** to use Remotica. By registering, you declare that you have legal age.
### 1.3 Changes to Terms
Remotica reserves the right to modify these T&C at any time. Substantial changes will be notified via email with at least 30 days' notice. Continued use of the platform after changes constitutes acceptance of the new terms.

## 2. Service Description
### 2.1 What Remotica Offers
Remotica is a digital platform that:
- Connects remote workers with public venues offering workspaces
- Allows you to search, compare and book workspaces in advance
- Processes payments securely via Stripe
- Provides booking confirmations and access codes
- Offers customer support via email/chat
### 2.2 What Remotica Does NOT Offer
Remotica is **NOT**:
- A coworking space directly managed by Remotica
- An employer or employment agency
- Responsible for the quality of services provided by Partners (WiFi, environment, cleanliness)
- Insurance for damages or accidents at Partner venues
**Remotica is only an intermediary technology platform.** The actual service (WiFi, space, environment) is provided by the Partner.

## 3. Registration and Account
### 3.1 Account Creation
To use Remotica you must:
1. Provide accurate information (name, email)
2. Create a secure password (min. 8 characters)
3. Verify email address
4. Accept these T&C and Privacy Policy
### 3.2 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your password
- All activities conducted through your account
- Immediately notifying Remotica in case of unauthorized access
**DO NOT share your account with third parties.**
### 3.3 Account Deletion
You can delete your account at any time via:
- Dashboard → Settings → Delete Account
- Email to support@remotica.com (subject: "Account Deletion")
**After deletion:**
- Future bookings will be cancelled
- Personal data will be deleted within 30 days (subject to legal obligations)
- Past booking history will be anonymized

## 4. Bookings and Payments
### 4.1 Booking Process
**Steps to book:**
1. Search workspaces by city, date, time
2. Select desired workspace and time
3. Confirm booking and proceed to payment
4. Receive confirmation via email with unique code (e.g., ABC123)
5. Show up at venue at booked time and show code
### 4.2 Prices and Fees
**Prices:**
- Prices are set by Partners and clearly shown before payment
- Prices include Italian VAT (22% if applicable)
- No hidden costs or additional fees for users
**Final price = Price shown on platform**
### 4.3 Payment Methods
**Accepted payments:**
- Credit/debit cards (Visa, Mastercard, American Express)
- Apple Pay, Google Pay
- Bancomat (if enabled by Stripe)
**Payment processing:**
- All payments are processed by **Stripe** (PCI-DSS certified)
- Remotica does **NOT store** your credit card data
- Payment occurs at time of booking (100% upfront)
### 4.4 Booking Confirmation
**After payment you receive:**
- Confirmation email with booking details
- Unique 6-character code (e.g., ABC123)
- Address and directions to reach the venue
- WiFi information (if provided by Partner)
**Keep the code:** You'll need it for check-in at the venue.

## 5. Cancellations and Refunds
### 5.1 Cancellation by You
**You can cancel via:**
- Dashboard → My Bookings → Cancel
- Email to support@remotica.com (with booking code)
**Refund Policy:**

| ≥2 hours before booked time | **100% (full refund)** |
| <2 hours before booked time | **0% (no refund)** |
| No-show | **0% (no refund)** |
**Refunds processed within:**
- 5-10 business days (same payment method used)
- Timing depends on bank/credit card
### 5.2 Cancellation by Partner
**If Partner cancels your booking:**
- You receive immediate notification via email/SMS
- **Automatic full refund** (100%)
- Remotica helps you find an alternative (if available)
**Partner cancellation reasons:**
- Unexpected venue closure
- Private event not communicated in advance
- Non-functioning WiFi
- Other technical issue
### 5.3 Booking Modifications
**Currently NOT supported.** To modify a booking:
1. Cancel existing booking (if >2 hours before)
2. Create a new booking
**"Modify booking" feature in roadmap.**

## 6. Workspace Usage
### 6.1 Check-In at Venue
**Upon arrival:**
1. Introduce yourself to staff saying "I have a Remotica booking"
2. Show confirmation code (email or smartphone)
3. Staff will verify code and give you WiFi
4. Take a seat and work!
**No check-out required:** When finished, you can leave freely.
### 6.2 Purchases
**Ordering purchases:** At your discretion, but **strongly recommended** for good etiquette.
**Remotica recommends:**
- At least 1 purchase every 2-3 hours
- Respect venue policies
- Courteous attitude towards staff and other customers
**Note:** Some Partners may require minimum purchase (indicated in workspace profile).
### 6.3 Booking Duration
**Times:** Strictly respect booking times.
- Start: Don't show up more than 15 minutes early
- End: Free the space by end time of booking
**To extend:** Create a new booking for subsequent hours (if available).
### 6.4 What to Expect
**Partner provides:**
- Seat with table (suitable for laptop)
- Functioning WiFi (minimum speed indicated in profile)
- Reasonably quiet environment for work
**Partner does NOT guarantee:**
- Absolute silence (public venues)
- Unlimited power outlets (availability may vary)
- Printers or office equipment
- Complete privacy (shared spaces)

## 7. User Obligations and Conduct
### 7.1 Acceptable Behavior
**You must:**
- Respect venue rules
- Maintain polite and professional behavior
- Leave space clean when finished
- Respect quiet of other customers
- Follow staff instructions
### 7.2 Prohibited Behavior
**Prohibited:**
- Using booking for illegal or inappropriate purposes
- Disturbing other customers (excessive noise, prolonged loud phone calls)
- Occupying more spaces than booked without authorization
- Damaging venue furniture or equipment
- Smoking in non-smoking areas
- Consuming outside food/drinks (unless agreed with Partner)
- Transferring booking to third parties without consent
- Taking screenshots or photos of space for commercial use without permission
### 7.3 Violation Consequences
**In case of serious violations:**
- Partner may ask you to leave the venue
- Remotica may suspend or cancel your account
- No refund for bookings cancelled due to violations
- Legal liability for damages caused

## 8. Feedback and Reviews
### 8.1 Feedback System
After each booking you can leave:
- Rating (1-5 stars)
- Text review (optional)
- Feedback on WiFi, cleanliness, noise, service
- Screenshots/photos (optional)
### 8.2 Review Guidelines
**Reviews must be:**
- Based on real personal experience
- Honest, constructive and respectful
- Relevant to services offered by workspace
**DO NOT publish:**
- Offensive, defamatory or discriminatory content
- Private or sensitive information
- False or manipulated reviews
- Promotional content or spam
**Remotica reserves the right to remove inappropriate reviews.**

## 9. Referral Program
### 9.1 How It Works
**Invite friends and earn:**
1. Share your personal referral link (Dashboard → Referral)
2. Friend registers via your link
3. Friend completes first booking
4. **You receive:** €5 Remotica credit
5. **Friend receives:** 20% discount on first booking
### 9.2 Conditions
**Valid credits:**
- Only for new registrations (never used Remotica before)
- Credit activated after friend's first booking completion
- Cumulative credits (no limit)
- Usable on future bookings
- Valid 12 months from receipt
**Abuse:** Referral links used fraudulently (fake accounts, abuse) result in credit cancellation and possible ban.

## 10. Intellectual Property
### 10.1 Remotica Content
**Remotica owns:**
- Logo, "Remotica" name, registered trademarks
- Platform design and interface
- Software, source code, algorithms
- Texts, graphics, photos produced by Remotica
**Prohibited:**
- Copying, reproducing or redistributing content without permission
- Reverse engineering software
- Using "Remotica" trademark without written authorization
### 10.2 User Content
**When you upload content (photos, reviews):**
- You remain owner of your content
- You grant Remotica worldwide, free, non-exclusive license to use it on platform and marketing
- You guarantee you have rights to upload such content
- Don't upload content that violates third-party rights

## 11. Limitation of Liability
### 11.1 Remotica's Responsibility
**Remotica is responsible for:**
- Functioning of technology platform
- Payment security via Stripe
- Data protection according to GDPR
**Remotica is NOT responsible for:**
- Quality, safety or suitability of workspaces provided by Partners
- Behavior of Partners or other users
- Damages, thefts, accidents occurring at Partner venues
- Non-functioning WiFi or services provided by Partner
- Loss of data, opportunities or earnings due to platform use
- Force majeure (server outages, hacker attacks, natural disasters)
### 11.2 Insurance
**You are responsible for:**
- Your safety and well-being at Partner venues
- Any personal insurance (liability, equipment)
- Backup of your data and work
**Remotica does not provide user insurance.** Consider personally whether to get professional liability or equipment insurance.
### 11.3 Liability Cap
**In no case shall Remotica's liability exceed:**
- Total amount paid by user in last 12 months
- Minimum €100 (one hundred euros)
**Exclusions:** Liability for intentional misconduct or gross negligence remains unlimited by law.

## 12. Dispute Resolution
### 12.1 Attempt at Conciliation
**In case of problems:**
1. Contact support@remotica.com describing the problem
2. Remotica will respond within 2-3 business days
3. We always seek an amicable solution before legal action
### 12.2 Governing Law
These T&C are governed by **Italian law**.
### 12.3 Jurisdiction
For disputes not resolvable amicably, jurisdiction lies with:

(Subject to mandatory jurisdictions by law, e.g., consumer resident elsewhere may bring action in court of residence)
### 12.4 Mediation
**Before going to court**, parties commit to attempting mediation according to Italian Legislative Decree 28/2010.

## 13. Miscellaneous Provisions
### 13.1 Severability
If a clause is declared invalid or unenforceable, other clauses remain valid.
### 13.2 Communications
**Official communications Remotica → User:**
- Sent to email registered in account
- Considered received 24 hours after sending
**Communications User → Remotica:**
- Email: support@remotica.com (general)
- Email: privacy@remotica.com (privacy/GDPR)
- Email: legal@remotica.com (legal matters)
### 13.3 Assignment
**You CANNOT assign** these T&C or your account to third parties.
**Remotica may assign** these T&C in case of merger, acquisition or business sale (with 30 days' notice).
### 13.4 Entire Agreement
These T&C, together with Privacy Policy and Cookie Policy, constitute the entire agreement between you and Remotica.
### 13.5 Force Majeure
Remotica is not responsible for delays or non-performance due to force majeure (wars, natural disasters, pandemics, hacker attacks, Internet outages, etc.).
